These Terms and Conditions (“Terms”) govern your use of the Averion Hair website, mobile application, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Averion Hair (“Company,” “we,” “us,” “our”) reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use constitutes acceptance of modified Terms.

Use License

We grant you a limited, non-exclusive, revocable license to access and use the Service for personal, non-commercial purposes. You agree NOT to:

Delivery Address

You are responsible for providing a correct delivery address. We are not liable for packages delivered to incorrect addresses provided by you.

Risk of Loss

Risk of loss transfers to you upon delivery to the carrier or your specified address. We are not responsible for items lost or damaged during transit (though we will assist with carrier claims).

Undeliverable Orders

If a package cannot be delivered, the carrier will attempt redelivery or return it to us. We will notify you and either re-ship or issue a refund at your request.

Returns & Refunds

30-Day Guarantee

We offer a 30-day money-back guarantee from the date of delivery. Products must be in original, unused condition in original packaging.

Refund Method

Refunds are issued to your original payment method. Processing time is 5-7 business days after we receive the return. Your bank or credit card company may require additional time to credit your account.

Defective Products

If you receive a defective product, we will replace it or issue a full refund at no cost, including return shipping.

Restocking Fee

We do not charge restocking fees on returns within 30 days.

All Averion products come with an implicit warranty of satisfactory quality. If products are defective, we will repair, replace, or refund as appropriate.

Natural Product Variation

Hair products may have natural variations in color, texture, and weight. Slight differences from images and descriptions are normal and do not constitute defects.

Limitations of Liability

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERION’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO AVERION IN THE 12 MONTHS PRECEDING THE CLAIM.

Excluded Damages

IN NO EVENT SHALL AVERION BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.

Service Availability

We do not guarantee uninterrupted or error-free Service. We are not liable for downtime, service interruptions, or technical errors.

Third-Party Content

We are not responsible for third-party websites, products, or services linked from our Service. Your interactions with third parties are solely your responsibility.

Intellectual Property Rights

Ownership

All content on the Service, including text, images, logos, graphics, and code, is owned by Averion or our licensors. Your use of the Service does not grant you ownership of any content.

“Averion,” “MeltGrip System,” and related logos are trademarks of Averion Hair. You may not use our trademarks without written permission.

User-Generated Content

By submitting reviews, comments, or other content, you grant us a worldwide, non-exclusive, perpetual license to use, modify, and display that content. You represent that you own or have rights to the content you submit.

Copyright Protection

If you believe your copyright has been infringed, contact us immediately with details and evidence. We will investigate and take appropriate action.

Termination & Suspension

Account Termination

You can terminate your account at any time by contacting us. We may terminate or suspend your account immediately if you violate these Terms.

Effect of Termination

Upon termination, your right to use the Service ends immediately. Any provisions that by their nature should survive termination (e.g., limitations of liability, intellectual property) shall continue.

Grounds for Suspension

We may suspend access to your account for:

Unauthorized or fraudulent activity
Non-payment of charges

Abusive behavior toward staff or other users

Dispute Resolution

If we suspend your account, we will notify you of the reason and allow 30 days to respond or appeal unless immediate suspension is necessary for security.

Waiver

Failure to enforce any right or provision does not constitute waiver of that right or provision.
